WHEREAS

the seizure of Channel 2 has continued for more than two years

WHEREAS

the relentless judicial persecution with which the government has tried to justify the seizure has also entangled Ivcher's colleagues, one of whom received a suspended four-year jail sentence, while another, one of his lawyers, faces a possible five-year prison sentence

WHEREAS

the Inter-American Human Rights Court has accepted the case concerning the violation of Mr. Ivcher's fundamental rights, including the right of press freedom

WHEREAS

defamatory, slanderous and degrading statements are being published about La República editor Gustavo Mohme Llona and journalists at this daily

WHEREAS

the attacks include the printing of coarse, illegal parodies of La República with names alluding to the publication such as La Repúdica and Repudio


WHEREAS

Principle 6 of the Declaration of Chapultepec states that the media or individual journalists should not be discriminated against nor favored because of what they write or say.

THE GENERAL ASSEMBLY OF THE IAPA RESOLVES

to urge President Alberto Fujimori. to fully reinstate Baruch Ivcher's Peruvian citizenship, allow him to return to the country without risking arrest and return to him the right to control his television station,

to instruct the Legal Committee to prepare an amicus curiae brief concerning the Ivcher case to submit to the Inter-American Human Rights Court

to urge the chief justice of the Supreme Court to end the judicial harassment of Baruch Ivcher

to urge President Alberto Fujimori as well to order an in-depth investigation of the attacks on the editor of La República so those responsible can be found and punished.
